THE PROCESS

How Does Civil Mediation Work?

Civil mediation is a straightforward and confidential process designed to help parties resolve disputes without going to court. It begins with an initial discussion where we learn about your situation and explain how mediation could help. If everyone agrees to proceed, all parties sign an Agreement to Mediate, which sets out the terms and confirms their commitment. A suitable date, time, and venue (or online platform) is then arranged, and each side is encouraged to prepare by considering the key issues and possible solutions. During the mediation session, the mediator facilitates open and constructive discussions, meeting with all parties together and, where helpful, speaking with each side privately.

If an agreement is reached, it is written up as a formal settlement, which can be made legally binding if required.

Civil Mediation Costs

We believe in being completely transparent about our fees so you know exactly what to expect from the start. Civil mediation is typically far more cost-effective than pursuing a dispute through the courts, often saving all parties significant time and money.

Our fees are usually based on the length and complexity of the mediation:

Half-day mediation: from £150 per party

Full-day mediation: from £250 per party

These fees are fixed and agreed in advance, so there are no hidden costs. In many cases, parties choose to share the cost equally, although alternative arrangements can be agreed if preferred.

MIAM Attendance

If you are applying to the courts for assistance in resolving disputes about children or finances, you will be required to attend a Mediation Information Assessment Meeting (MIAM).

This includes any applications for:

  • Child Arrangements Order
  • Specific Issue Order
  • Prohibited Steps Order
  • Parental Responsibility Order
  • An order appointing a Child’s Guardian
  • Removal from Jurisdiction Order
  • Special Guardianship Order.

You can be exempt from having to attend a MIAM if you fulfil one of the exceptions outlined in paragraph 3 of the C100 application form, which can be downloaded from www.justice.gov.uk.
